G MAGAZINE PLATFORM TERMS AND CONDITIONS OF USE

Welcome to G Magazine. These Terms and Conditions of Use ("Terms") govern your access to and use of our social network platform ("Platform"), including the website, applications, and related services.

By creating an account or using our Platform, you agree to comply with and be legally bound by these Terms. If you do not agree with any part of the Terms, you must not use the Platform.

1. DEFINITIONS

• Platform: Refers to the G Magazine social network, operated by JETIX (Corporate Taxpayer ID 62.474.578/0001-37).
• User: Any person who accesses or uses the Platform.
• Creator User (or "Creator"): A User who uses the Platform to publish content for monetization purposes.
• Content: Refers to all photos, videos, texts, information, links, and other materials that a User posts, uploads, or displays on the Platform.

2. OFFERED SERVICES

The G Magazine Platform is a social network designed to connect people, promote freedom of expression, and provide an environment for Creator Users to monetize their original content. Services include, but are not limited to, profile creation, content publishing, user interaction, and monetization tools.

3. SUBSCRIPTION PLANS (G MAGAZINE STATUS)

Users may choose to upgrade their status on the Platform by subscribing to one of the following paid plans, which offer additional benefits and features:

3.1. Payment and Renewal: Payments are processed monthly, and the subscription will automatically renew unless canceled by the User before the renewal date.

3.2. Cancellation: The User may cancel their subscription at any time through their account settings. The cancellation will take effect in the following billing cycle. There will be no refunds for partial subscription periods.

4. CONTENT MONETIZATION FOR CREATORS

4.1. Service Fee: G Magazine offers Creators the opportunity to monetize their Content. As remuneration for the license to use the Platform, payment processing, and other services, G MAGAZINE will retain a service fee of 15% (fifteen percent) of the gross value of all transactions paid by the Creator's fans and subscribers. The remaining 85% (eighty-five percent) will be transferred to the Creator.

4.2. Tax Liability: The Creator User is solely and exclusively responsible for the payment of all taxes (e.g., Income Tax, ISS) levied on the amounts received through the Platform.

5. CREATOR SUPPORT PROGRAM

5.1. Guidance: G Magazine, as a distinguishing feature, will offer Creator Users access to a support program with guidance in the legal, trademark registration, and social security areas.

5.2. Informational Nature: It is expressly stated that this service is of a purely informational and educational nature. The guidance provided does not constitute formal legal consultancy, accounting advisory, or professional advice.

5.3. Disclaimer of Liability: G Magazine is not responsible for the decisions made by the Creator based on this guidance. It is strongly recommended that the Creator always seek the advice of a qualified lawyer or accountant to handle their specific issues.

6. RESPONSIBILITY FOR USER CONTENT AND CONDUCT

6.1. Personal Responsibility: The User is solely and exclusively responsible for all Content they publish on the Platform and for the legal consequences arising from their actions.

6.2. Prohibited Content: It is strictly forbidden to publish Content that is: a) Illegal, pornographic (involving minors), violent, or that incites hatred, discrimination, or violence. b) Defamatory, slanderous, or libelous, or that violates the honor and image of third parties. c) That infringes upon the intellectual property rights (copyrights, trademarks) of third parties. d) That contains spam, viruses, or any malicious code. e) That violates the privacy rights of third parties, such as disclosing personal information without consent.

6.3. Moderation and Banning: G MAGAZINE reserves the right, but not the obligation, to monitor, analyze, and remove any Content that, at its sole discretion, violates these Terms, without prior notice. A serious or repeated violation of these Terms may result in the temporary suspension or permanent ban of the User from the Platform, without prejudice to applicable legal measures.

7. INTELLECTUAL PROPERTY

7.1. User Content: The User retains all intellectual property rights to their own Content. However, by publishing on the Platform, you grant G Magazine a non-exclusive, worldwide, royalty-free license to use, host, display, reproduce, and distribute your Content, strictly for the purposes of operating and promoting the Platform.

7.2. G Magazine's Property: The G Magazine brand, its logo, the Platform's design, software, and all content created by G Magazine are the exclusive property of JETIX and are protected by intellectual property laws.

8. ABSENCE OF EMPLOYMENT RELATIONSHIP

It is expressly established that the relationship between G MAGAZINE and the Creator User is strictly of a civil and commercial nature, configured as a licensing relationship for the use of a digital platform. There is not, and shall not be interpreted to be, any kind of employment, corporate, representative, or any other labor-related bond between the Creator and G Magazine. The Creator acts as an autonomous and independent professional.

9. LIMITATION OF LIABILITY

The Platform is provided "as is". G Magazine does not guarantee that the Platform will be uninterrupted or error-free and is not liable for any loss or damage arising from the use of the Platform, the conduct of other users, or technical failures.

10. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of the Federative Republic of Brazil. The courts of the district of Belo Horizonte, State of Minas Gerais, are hereby elected to resolve any controversies arising from these Terms, with the express waiver of any other, however privileged it may be.
